By accessing or using the KernelFlow platform, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not use our services.

2. Definitions

• "Company" refers to KernelFlow Infrastructure Labs.
• "Service" refers to the KernelFlow platform, including all software, APIs, and documentation.
• "User" means any individual or entity that accesses or uses our Service.
• "Content" means any data, text, images, or other material uploaded or generated through our Service.

3. Account Registration

To use the Service, you must register for an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the security of your credentials and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable l or regulations.
• Generate, distribute, or promote illegal, harmful, or offensive content (including malware, hate speech, or child exploitation).
• Interfere with or disrupt the integrity or performance of the Service.
• Attempt to gain unauthorised access to other accounts or systems.

5. Intellectual Property

All intellectual property rights in the Service, including software, algorithms, documentation, and trademarks, are owned by KernelFlow Infrastructure Labs. You are granted a limited, non‑exclusive, non‑transferable license to use the Service in accordance with these terms.

6. Data Ownership

You retain full ownership of all data and content you submit to the Service. We do not claim any ownership rights over your data. You grant us a limited license to process your data solely for the purpose of providing the Service.

7. Fees & Payments

Fees for paid plans are described on our Pricing page. All fees are non‑refundable unless otherwise stated. We reserve the right to change fees with 30 days' notice.

8. Service Level Agreement (SLA)

KernelFlow commits to a 99.99% uptime SLA for enterprise customers. If we fail to meet this commitment, you are eligible for service credits as described in our SLA.

9. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the Service will be suspended, and we will delete your data after a 30‑day grace period unless otherwise required by law.

10. Limitation of Liability

To the maximum extent permitted by law, KernelFlow shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or related to your use of the Service.

11. Warranty Disclaimer

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error‑free, or completely secure.

12. Governing Law

These Terms shall be governed by and construed in accordance with the l of the State of California, USA, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of San Francisco, California.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or through a notice on our website. Your continued use of the Service constitutes acceptance of the revised Terms.
